Terms of Use

The general agreement between Chez, LLC and each household, chef, and visitor who uses the Platform. This document is prepared in plain, editorial language for clarity and readability.

These Terms of Use govern access to and use of Chez, LLC's websites, applications, communications, reservation tools, household services, chef-facing tools, and related offerings collectively referred to as the “Platform.”

Chez, LLC provides technology, hospitality support, payment coordination, trust and safety tools, and other services intended to help households discover, request, and manage personal chef experiences.

These Terms form a legally binding agreement between you and Chez, LLC when you create an account, access the Platform, make or accept a reservation, or otherwise use the services.

Additional terms may apply depending on how you use Chez, LLC. These may include the Household Agreement, Chef Services Agreement, Cancellation and Refund Policy, Community Standards, Privacy Policy, Electronic Communications Consent, and applicable service-specific or state-specific terms.

Where another Chez, LLC agreement applies specifically to a reservation, service, payment, or participant relationship, that agreement will supplement these Terms. If there is a direct conflict, the more specific agreement will govern the subject addressed by that agreement.

§ 01

Acceptance of Terms

By accessing or using the Platform, creating an account, submitting information, requesting or accepting a reservation, or selecting a button indicating agreement, you acknowledge that you have read and understood these Terms and agree to be bound by them.

If you do not agree to these Terms, you may not create an account, request or provide services through Chez, LLC, or otherwise use restricted portions of the Platform.

If you use Chez, LLC on behalf of a business, household, trust, family office, property-management organization, or other entity, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes both you and the organization you represent.

Certain provisions of these Terms limit Chez, LLC's liability and require individual dispute resolution. Review those provisions carefully before using the Platform.

§ 02

Eligibility

You must be at least eighteen years old and legally capable of entering into a binding contract to create a Chez, LLC account or enter into a reservation.

You may not use the Platform if:

  • You are prohibited from receiving the services under applicable law.
  • Your Chez, LLC account has been suspended or terminated for safety, fraud, legal, or policy reasons.
  • You are attempting to use another person's identity without authorization.
  • You are using the Platform for an unlawful, deceptive, or unauthorized purpose.
  • You cannot provide legally valid consent to these Terms.
§ 03

Account Registration

Some features require an account. When registering, you must provide requested information and complete any identity, contact, payment, or verification steps that apply to your role.

You may not:

  • Create an account using false or misleading information.
  • Create an account for another person without authorization.
  • Maintain duplicate accounts to avoid restrictions or enforcement.
  • Transfer, sell, rent, or share your account with an unauthorized person.
  • Use an account that belongs to another person.
  • Misrepresent your relationship with a household, chef, property, or organization.

Accurate Information

You agree to provide complete, current, and accurate information and to promptly update it when circumstances change.

Information that must remain accurate may include:

  • Name and contact information
  • Service address
  • Billing information
  • Household access instructions
  • Allergy and dietary information
  • Kitchen and equipment information
  • Pet information
  • Emergency contacts
  • Chef credentials
  • Licenses and certifications
  • Insurance information
  • Availability
  • Tax and payout information
  • Background-screening information
  • Reservation details
§ 05

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to:

  • Use a secure password.
  • Keep authentication codes confidential.
  • Use multi-factor authentication when required or available.
  • Notify Chez, LLC promptly of suspected unauthorized access.
  • Log out of shared or public devices.
  • Maintain control of the email address and phone number connected to your account.
§ 06

The Role of the Chez, LLC Platform

Chez, LLC operates a curated technology and hospitality platform that helps households and chefs connect, communicate, arrange services, coordinate payments, and manage aspects of an in-home culinary experience.

Depending on the service and market, Chez, LLC may provide chef discovery and matching, reservation technology, household and chef onboarding, menu and preference tools, communication features, payment processing or payment coordination, grocery-budget and reimbursement tools, document and credential collection, customer support, trust and safety processes, incident reporting, reviews and service feedback, and administrative and concierge support.

Unless Chez, LLC expressly states otherwise in a separate written agreement, Chez, LLC is not the owner or operator of the household, a restaurant, a food-delivery provider, a medical or nutritional care provider, a guarantor of any individual participant, a party to private arrangements made outside the Platform, the employer of a household, or the employer of a chef merely because the chef uses the Platform.

The precise legal relationship between Chez, LLC, chefs, and households may depend on the service model, applicable agreement, location, and surrounding facts. No label in these Terms overrides applicable law.

Chez, LLC does not direct a chef's culinary judgment, cooking technique, or professional method except to the extent necessary to administer Platform requirements, legal obligations, safety standards, reservation terms, or household disclosures.

§ 07

Household and Chef Relationships

Households and chefs are responsible for interacting professionally and complying with the agreements applicable to their respective roles.

Households are responsible for providing accurate service and access information; maintaining a reasonably safe working environment; disclosing allergies, dietary restrictions, pets, children, security systems, and material household conditions; providing access to agreed kitchen spaces and equipment; treating chefs and other participants respectfully; paying authorized charges; supervising minors and household guests; and avoiding discriminatory, harassing, coercive, or unsafe conduct.

Chefs are responsible for accurately representing their experience and credentials; maintaining required food-safety qualifications and insurance; performing accepted services professionally; following applicable food-safety and sanitation requirements; honoring confirmed reservations or following the applicable cancellation process; protecting household information and property; avoiding discriminatory, harassing, coercive, or unsafe conduct; and complying with the Chef Services Agreement.

Chez, LLC may facilitate the relationship but does not guarantee compatibility, satisfaction, uninterrupted availability, or a particular outcome.

§ 08

Booking Rules

A reservation is not confirmed until all required confirmation steps are completed and the Platform displays a confirmed status.

A reservation process may require submission of a household request, chef availability confirmation, menu or service-scope approval, household confirmation, grocery-budget approval, payment authorization, acceptance of applicable agreements, and completion of verification or safety requirements.

Displayed chef availability is not a guarantee that a reservation will be accepted.

You may not use Chez, LLC to:

  • Circumvent applicable Platform fees.
  • Move an introduced relationship outside the Platform in violation of an applicable agreement.
  • Create a false reservation.
  • Reserve services for an undisclosed commercial event.
  • Misrepresent the number of guests.
  • Conceal material food-safety or property conditions.
  • Request unlawful or discriminatory services.
  • Arrange work that is materially different from the confirmed reservation without agreement.
§ 09

Payment Authorization

When you provide a payment method, you represent that you are authorized to use it and authorize Chez, LLC and its payment providers to process charges connected with your account and reservations.

Depending on the transaction, charges may include chef service charges, Platform or reservation fees, grocery budgets, approved grocery overages, reimbursements, travel charges, taxes, gratuities, cancellation charges, damage-related charges where properly documented and legally permitted, and other amounts clearly disclosed before authorization.

Chez, LLC may place a temporary authorization hold before the service. An authorization hold is not necessarily a completed charge and may affect the available balance on your payment method.

You are responsible for maintaining a valid payment method. Failure of a payment method does not eliminate a valid payment obligation.

Disputed charges should be reported promptly through Household Support. Chez, LLC may request documentation and may pause payouts or account activity while reviewing a dispute.

§ 10

Fees

Prices and fees will be disclosed through the Platform, a reservation proposal, a service agreement, or another written communication before the applicable transaction is finalized.

Fees may vary based on market, chef, experience type, date and duration, number of guests, travel requirements, menu complexity, grocery requirements, recurring-service arrangement, concierge or Founder Collection support, and applicable taxes and regulatory requirements.

Unless stated otherwise, Platform fees compensate Chez, LLC for access to technology, coordination, payment support, trust and safety operations, and other Platform services.

Chez, LLC may change future prices or fees. Changes will not retroactively alter a confirmed reservation unless the reservation itself is materially changed or the parties otherwise agree.

§ 11

Taxes

Users are responsible for taxes legally assigned to them.

Chez, LLC may calculate, collect, withhold, report, or remit taxes where required or where Chez, LLC elects to do so as permitted by law.

Chefs remain responsible for understanding and satisfying their own tax, licensing, registration, and reporting obligations unless a written agreement expressly states otherwise.

Chez, LLC does not provide personal tax, accounting, or legal advice.

Tax treatment may vary based on location, service structure, business status, and applicable law. Users should consult qualified advisers regarding their individual obligations.

§ 12

Cancellations

Cancellations are governed by the Cancellation and Refund Policy and any service-specific terms displayed during the reservation process.

The applicable outcome may depend on when the cancellation occurs, whether the reservation was confirmed, grocery purchases already made, nonrefundable expenses, chef travel, menu-preparation work, force majeure conditions, safety concerns, material household or service changes, and whether Chez, LLC or a chef can provide a replacement.

Users must cancel through the designated Platform process whenever reasonably possible.

A message sent outside the designated cancellation process may not be sufficient unless Chez, LLC confirms receipt.

Repeated late cancellations, no-shows, payment failures, or misuse of cancellation protections may lead to account restrictions.

§ 13

Refunds

Refund eligibility is governed by the Cancellation and Refund Policy and applicable law.

Refunds are not automatically available merely because:

  • A user's personal preference changed.
  • A household failed to disclose relevant information.
  • A user failed to attend or provide access.
  • A meal or experience differed from a subjective expectation that was not part of the confirmed reservation.
  • A third-party payment institution delayed processing.
§ 14

Prohibited Conduct

You may not use Chez, LLC to engage in conduct that is unlawful, unsafe, abusive, deceptive, discriminatory, or harmful.

Prohibited conduct includes:

  • Fraud or attempted fraud
  • Identity theft or impersonation
  • Payment abuse
  • Fee circumvention
  • False reservations
  • Harassment or threats
  • Sexual misconduct
  • Retaliation
  • Discrimination
  • Hate speech
  • Human trafficking or exploitation
  • Stalking
  • Unauthorized surveillance or recording
  • Theft or property damage
  • Violence or threats of violence
  • Dangerous intoxication
  • Illegal drug activity
  • Unauthorized weapons
  • Food tampering
  • Deliberate concealment of allergens
  • Misrepresentation of professional qualifications
  • Manipulated reviews
  • Unauthorized access to accounts or systems
  • Malware, scraping, or automated extraction
  • Reverse engineering where prohibited
  • Interference with Platform operations
  • Collection of another user's information for unauthorized purposes
  • Use of Chez, LLC to recruit participants into an unrelated competing or unlawful arrangement in violation of an applicable agreement
§ 15

Fair Access and Nondiscrimination

Chez, LLC does not permit users to exclude, mistreat, harass, or disadvantage another participant based on a characteristic protected by applicable federal, state, or local law.

Protected characteristics may include, depending on applicable law: race, color, national origin, ethnicity, religion, sex, pregnancy, sexual orientation, gender identity, age, disability, genetic information, veteran or military status, marital or familial status, and any other legally protected status.

Household preferences may be considered when they are connected to legitimate culinary, dietary, privacy, cultural, accessibility, safety, or service requirements and are permitted by law.

Requests that appear discriminatory may be paused for human review.

Chez, LLC may decline, cancel, restrict, or investigate a request that violates the Fair Access and Community Commitment, Community Standards, or applicable law.

Good-faith reports of discrimination, harassment, safety concerns, or policy violations must not result in retaliation.

§ 16

User Content

“User Content” means information or material a user submits through Chez, LLC, including profile information, photos, menus, messages, reviews, comments, recipes, service preferences, incident reports, documents, and uploaded media.

You retain ownership of User Content to the extent you own it.

By submitting User Content, you grant Chez, LLC a limited, nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, transmit, and otherwise use the content as reasonably necessary to operate the Platform, complete reservations, provide support, maintain records, investigate reports, protect safety and security, comply with law, improve Platform functionality, and display content you intentionally make public.

This license does not authorize Chez, LLC to sell private household content as an independent product.

You represent that you have the right to submit the content and that its submission does not violate another person's privacy, intellectual-property rights, or other legal rights.

Chez, LLC may remove or restrict content that violates law, these Terms, Community Standards, privacy rights, or safety requirements.

§ 17

Reviews and Feedback

Chez, LLC may allow verified participants to provide reviews or service feedback.

Reviews must reflect the reviewer's genuine experience and may not be fake, purchased, fabricated, submitted through an undisclosed conflict of interest, conditioned on a particular positive or negative sentiment, used for extortion, retaliatory, discriminatory, harassing, knowingly false, or manipulated through duplicate accounts.

Chez, LLC may use automated tools and human review to identify suspected fraud, abuse, irrelevant material, private information, or policy violations.

Chez, LLC will not require a consumer to surrender ownership of an honest review as a condition of using the Platform.

Nothing in these Terms prohibits an honest review, lawful complaint, regulatory report, or good-faith statement about a user's experience.

Chez, LLC may remove content that is unlawful, fraudulent, unrelated to the service, threatening, obscene, invasive of privacy, or otherwise violates published moderation standards.

Positive and negative reviews should be evaluated under the same moderation standards.

§ 18

Intellectual Property

The Platform and its original content, branding, technology, visual design, text, software, workflows, trademarks, logos, service names, and other materials are owned by Chez, LLC or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, Chez, LLC grants you a limited, revocable, nonexclusive, nontransferable license to use the Platform for its intended purpose.

You may not:

  • Copy or commercially exploit Platform content without authorization.
  • Use Chez, LLC branding in a misleading manner.
  • Register confusingly similar names or domains.
  • Remove copyright, trademark, or proprietary notices.
  • Represent that Chez, LLC endorses an unrelated service.
  • Reproduce confidential Platform workflows or data.
  • Scrape or systematically extract Platform content.
  • Create derivative services from protected Platform materials except as permitted by law.
§ 19

Third-Party Services

Chez, LLC may rely on third-party services such as payment processors, identity-verification providers, background-screening providers, mapping services, email and messaging providers, cloud-hosting providers, analytics providers, insurance-verification providers, and customer-support systems.

Third-party services may be governed by their own terms and privacy practices.

Chez, LLC does not control every aspect of a third-party service and is not responsible for a third party's independent acts, omissions, outage, or security incident except to the extent responsibility cannot legally be excluded.

Links to third-party websites are provided for convenience and do not necessarily constitute endorsement.

§ 20

Availability of Services

Chez, LLC does not guarantee that the Platform will always be available; that a chef will be available in every market; that a particular chef will accept a request; that every service category will be offered in every location; that every feature will remain unchanged; that every reservation can be completed; that communications will be uninterrupted; or that third-party services will operate without error.

Chez, LLC may modify, suspend, test, discontinue, or geographically limit features.

Chez, LLC may cancel or reassign a reservation when reasonably necessary because of chef illness, emergency, severe weather, unsafe conditions, payment failure, verification concerns, Platform malfunction, legal restrictions, force majeure, material misrepresentation, or other circumstances outside reasonable control.

Chez, LLC will make reasonable efforts to communicate material reservation changes.

§ 21

Food, Allergy, and Health Disclaimer

Chez, LLC and participating chefs may use reasonable processes to record and communicate allergy and dietary information, but no food-preparation environment can be guaranteed to be completely free of allergens or cross-contact.

Households must disclose known food allergies, intolerances, dietary restrictions, religious dietary requirements, medical dietary instructions, ingredient sensitivities, and cross-contact concerns.

Chefs must review available disclosures and follow applicable food-safety practices.

Chez, LLC is not a medical provider. Information supplied through the Platform is not medical diagnosis, treatment, or individualized healthcare advice.

A household with a severe or life-threatening allergy should consult an appropriate medical professional before reserving an in-home culinary service and should maintain any medically recommended emergency plan.

§ 22

Disclaimers

To the fullest extent permitted by law, the Platform is provided on an “as available” and “as is” basis.

Chez, LLC does not make a blanket guarantee regarding a particular culinary result, compatibility between users, continuous Platform availability, the accuracy of every user-submitted statement, the future conduct of any participant, a chef's continued availability, or a specific financial, wellness, dietary, or hospitality outcome.

Verification, screening, credentials, reviews, badges, or insurance information may reduce certain risks but do not eliminate all risk and do not constitute a guarantee of future behavior.

Some jurisdictions do not permit the exclusion of certain warranties. Any exclusion in these Terms applies only to the extent permitted by law.

§ 23

Limitation of Liability

To the fullest extent permitted by applicable law, Chez, LLC and its owners, officers, employees, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Platform.

This may include loss of profits, loss of data, loss of opportunity, reputational harm, or interruption of business, even when the possibility of such damages was communicated.

To the fullest extent permitted by law, Chez, LLC's aggregate liability arising from a claim related to the Platform will not exceed the greater of the amount of Platform fees paid by the claimant to Chez, LLC during the twelve months preceding the event giving rise to the claim, or one hundred United States dollars.

This limitation does not apply to liability that cannot legally be limited, which may include certain claims involving fraud, intentional misconduct, gross negligence, personal injury, statutory consumer rights, or other non-waivable legal rights.

§ 24

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Chez, LLC and its affiliates, officers, employees, and representatives from third-party claims arising from your unlawful use of the Platform; your material breach of these Terms; content you submit; your violation of another person's rights; your intentional misconduct; your fraud or material misrepresentation; your failure to comply with applicable law; or property, safety, or access conditions under your control that you failed to disclose.

Chez, LLC will provide reasonable notice of a covered claim and may control the defense where appropriate.

This provision does not require a consumer to indemnify Chez, LLC for Chez, LLC's own unlawful conduct, negligence where prohibited, or obligations that cannot legally be transferred.

§ 25

Suspension and Termination

You may stop using Chez, LLC at any time and may request account closure, subject to record-retention requirements, unresolved transactions, active reservations, legal holds, fraud prevention, and other lawful obligations.

Chez, LLC may warn, limit, suspend, deactivate, or terminate an account when reasonably necessary to address safety concerns, fraud, payment abuse, legal requirements, repeated cancellations, harassment, discrimination, retaliation, false information, credential expiration, insurance expiration, misuse of the Platform, material breach of an agreement, or risk to Chez, LLC, users, or third parties.

Where appropriate, Chez, LLC may provide notice and an opportunity to respond. Immediate action may be taken when Chez, LLC reasonably believes delay could create a safety, legal, fraud, or security risk.

Termination does not eliminate obligations that arose before termination.

Provisions that logically must survive termination will remain in effect, including provisions concerning payments, intellectual property, records, disputes, limitations, and indemnification.

§ 26

Electronic Communications

By using Chez, LLC, you agree that Chez, LLC may provide transactional communications electronically, including through email, text message, in-Platform notification, account dashboard, electronic document, or other contact methods you authorize.

Transactional communications may include account verification, reservation updates, menu approvals, payment receipts, safety communications, agreement notices, policy updates, support responses, and legal notices.

Marketing communications are governed by separate consent and opt-out controls where required.

You may withdraw consent to certain electronic communications, but doing so may affect your ability to use services that require electronic records.

You are responsible for maintaining current contact information and access to a device capable of receiving electronic records.

Electronic acceptance may be recorded through timestamps, account identifiers, document versions, technical logs, and affirmative actions such as selecting “I Agree.”

§ 27

Governing Law

Except where applicable law requires otherwise, these Terms and disputes relating to them will be governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

Mandatory protections provided by the law of a consumer's residence remain applicable where they cannot legally be waived.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

§ 28

Informal Dispute Resolution

Before initiating arbitration or litigation, the claimant must send a written Notice of Dispute unless immediate legal relief is reasonably necessary.

The notice should include the claimant's name, account email address, description of the dispute, relevant reservation or transaction, requested resolution, and supporting documentation.

Send the notice to admin@chezkitchen.com.

The parties will attempt in good faith to resolve the matter for at least thirty days after receipt.

This informal process does not prevent either party from reporting a matter to a government agency or seeking emergency relief where legally permitted.

§ 29

Individual Arbitration Agreement

IMPORTANT: This section affects your right to bring a claim in court and to have a jury decide your claim.

Except for excluded claims and where prohibited by law, disputes not resolved through the informal process will be resolved through binding individual arbitration administered by the American Arbitration Association under the rules applicable to the dispute.

Arbitration may take place remotely, by written submissions, in the county where the consumer resides, or at another mutually agreed location.

The arbitrator may award the same individual remedies a court could award, subject to applicable law and the terms of this agreement.

The parties will share or allocate arbitration fees according to applicable arbitration rules and law. Chez, LLC will not require a consumer to pay fees that would make the arbitration process legally inaccessible.

Either party may bring an eligible individual claim in small-claims court.

Claims concerning intellectual-property infringement, unauthorized system access, theft of confidential information, or immediate threats to safety may be brought in court where injunctive relief is legally available.

Nothing prevents a person from reporting a concern to a government agency.

This arbitration section is governed by the Federal Arbitration Act where applicable.

§ 30

Right to Opt Out of Arbitration

A user may opt out of the arbitration provision by sending written notice within 30 days after first accepting a published version of these Terms containing the arbitration provision.

The notice must include full legal name, Chez, LLC account email address, a clear statement that the user is opting out of arbitration, and date of notice.

Send the notice to admin@chezkitchen.com.

Opting out of arbitration will not, by itself, affect access to Chez, LLC.

An opt-out applies only to the person who timely submitted it and does not automatically apply to another household member or entity.

§ 31

Class-Action and Jury-Trial Waiver

To the fullest extent permitted by law, disputes subject to arbitration must be brought only in an individual capacity and not as a plaintiff or class member in a purported class, collective, consolidated, coordinated, mass, or representative proceeding.

Unless all affected parties agree otherwise, an arbitrator may not combine claims belonging to different individuals.

For disputes properly resolved through arbitration, each party waives the right to a jury trial.

If a court determines that a specific portion of this waiver is unenforceable for a particular claim, that portion will be severed and the remaining enforceable provisions will continue to apply to the extent permitted by law.

§ 32

Changes to These Terms

Chez, LLC may update these Terms to reflect changes to Platform services, legal or regulatory developments, safety practices, new markets, technology changes, payment processes, business-model changes, or clarifications or corrections.

Each published version must include a version number, publication date, effective date, plain-language summary of material changes, prior-version archive, and reacceptance requirement, if applicable.

Material changes will be communicated through reasonable methods, which may include email, account notification, or an in-Platform notice.

Changes will not apply retroactively unless legally permitted and clearly disclosed.

Continued use after the effective date may constitute acceptance when permitted by law. Where affirmative consent is required, Chez, LLC will obtain it before the change becomes binding.

§ 33

Severability

If a court or arbitrator determines that a provision of these Terms is invalid or unenforceable, the provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect, unless the invalid provision is essential to the overall agreement and applicable law requires a different result.

§ 34

No Waiver

Chez, LLC's failure to enforce a provision does not waive the right to enforce it later.

A waiver is effective only when made in writing by an authorized Chez, LLC representative and applies only to the specific circumstance described.

§ 35

Assignment

You may not assign or transfer your rights or obligations under these Terms without Chez, LLC's prior written consent.

Chez, LLC may assign these Terms in connection with a merger, reorganization, financing, sale of assets, corporate restructuring, or transfer of the Platform, subject to applicable law and privacy obligations.

§ 36

Entire Agreement

These Terms, together with the policies and agreements incorporated by reference, constitute the agreement governing general use of the Platform.

They do not replace a signed service-specific agreement, reservation proposal, household agreement, chef agreement, or state addendum that expressly applies to a particular matter.

For urgent safety concerns, use the Report a Concern process within the Platform. Chez, LLC is not an emergency-response service. If there is an immediate threat to life or safety, contact the appropriate local emergency service.

Governing Hierarchy

Where a reservation-specific agreement exists, that agreement controls. Otherwise the Chef Services Agreement, Household Service Agreement, Terms of Use, Cancellation & Refund Policy, Privacy Policy, Community Standards, and Trust & Safety apply in that order. If two documents appear inconsistent, the more specific agreement controls.

Acceptance

Acceptance

By creating an account or completing a reservation, you affirmatively accept the current version of the Terms of Use. Continued browsing of this page does not, on its own, constitute acceptance.
